Effective date: September 22, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you and Medical Database ("we", "us", "our") governing your access to and use of LabNecessity (the "App"). By creating an account or otherwise using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 18 years old and able to form a binding contract to use the App. LabNecessity is offered only within the United States.
2. Description of Service
LabNecessity helps healthcare providers, billing staff, and institutional users look up whether a lab test is likely to be considered medically necessary for a given diagnosis, procedure, payer, and state. The necessity-check form takes exactly three inputs — a diagnosis code (ICD-10), a procedure/test code (CPT), and a state — with no field for a patient's name or other identifying information. The App also lets you review your own history of past checks and manage your account and subscription.
3. Eligibility and Account Registration
To use the App you must:
•
Provide accurate, current information when creating your account (name, email, and state), and keep it up to date.
•
Keep your login credentials confidential and notify us promptly of any unauthorized use of your account.
•
Be the person you claim to be — accounts may not be shared, sold, or transferred to another person.
•
If your access is granted through an institution (e.g. an employer or school), also comply with any additional terms your institution has agreed to with us, and understand that your institution's administrator controls whether that access stays active.
4. Acceptable Use
When using the App, you agree not to:
•
Attempt to work around the App's structured inputs (diagnosis code, procedure/test code, and state) to submit patient names, dates of birth, medical record numbers, or any other patient-identifying information. LabNecessity is a coverage-lookup tool, not a medical record system, and is not designed or authorized to store patient health information.
•
Use the App for any unlawful purpose, or in a way that infringes the rights of, or restricts or inhibits the use of the App by, anyone else.
•
Attempt to reverse engineer, decompile, scrape, or gain unauthorized access to the App, its underlying data (including the diagnosis/procedure code reference data or coverage-policy data), or its infrastructure.
•
Resell, sublicense, or provide access to the App to anyone who has not agreed to these Terms, or use one account on behalf of multiple unaffiliated individuals or organizations beyond what your plan or institutional agreement permits.
•
Interfere with or disrupt the App's operation, or introduce malware or other harmful code.
•
Use automated means (bots, scripts) to access the App outside of any interface we provide for that purpose.
5. Informational Results Only — No Medical, Legal, or Billing Advice
Coverage-necessity results shown in the App are generated from the diagnosis codes, procedure codes, and state you enter, and are provided for informational and workflow purposes only. They are an estimate — not a guarantee of coverage, medical necessity, reimbursement, or how any payer will actually adjudicate a claim. They do not constitute medical, legal, billing, or coding advice, and are not a substitute for the independent professional judgment of a qualified provider or biller, or for verification directly with the applicable payer. Final coverage and payment decisions rest solely with the applicable payer. You are responsible for how you use the App's output, including any decisions made or claims submitted based on it.
6. Subscriptions, Billing, and Free Trial
Individual access to LabNecessity beyond any free trial requires an active paid subscription, billed monthly or annually, purchased and managed through Apple's App Store or Google's Play Store (in-app purchase). By subscribing you authorize Apple or Google to charge your chosen payment method on a recurring basis until you cancel.
•
Free trial: new subscriptions include a 7-day free trial. Unless you cancel before the trial ends, it automatically converts into a paid subscription and you will be charged.
•
Auto-renewal: subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current price, unless canceled at least 24 hours before the renewal date.
•
Usage allowance: each billing period includes a set number of checks (published in the App and on the subscription selection screen); unused checks do not roll over to the next period.
•
Cancellation: you can cancel anytime through your Apple ID or Google Account subscription settings. Canceling stops future renewals but does not refund the current period — you keep access through the end of the period you already paid for or are trialing.
•
Payments and refunds: Apple and Google process all payments directly; we never receive or store your card details. Refund requests are handled by Apple or Google under their own refund policies, not by us directly.
•
Price changes: we may change subscription prices going forward; any change will be presented to you (via the App Store/Play Store) before it applies to your next renewal.
7. Institutional Accounts
If your account is provided through an enrolled institution (e.g. your employer or school), your access is derived from that institution's arrangement with us, not from an individual subscription, and is granted automatically when you sign up with an email address matching the institution's registered domain. Billing for institutional access is arranged separately between the institution and us, outside the App. An institution's administrator can deactivate that institution's access at any time (which ends access for everyone under it) or set a usage allowance different from the standard individual plan. We are not responsible for disputes between you and your institution over access, allowance, or continued enrollment.
8. Intellectual Property
The App, including its software, design, text, graphics, logos, and the compiled reference data and coverage-policy content made available through it, is owned by Medical Database or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for its intended purpose. All rights not expressly granted are reserved.
9. Term and Termination
These Terms apply for as long as you use the App. You may stop using the App and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if we reasonably believe your use poses a risk to the App or other users, if required by law, or if your subscription or institutional access lapses. Sections of these Terms that by their nature should survive termination (including Sections 5, 8, 10, 11, 12, and 13) will survive.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY COVERAGE-NECESSITY RESULT WILL BE ACCURATE, COMPLETE, OR ACCEPTED BY ANY PAYER.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MEDICAL DATABASE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ANY RESULT IT PRODUCES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100 IF YOU HAVE NOT PAID US ANYTHING. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to defend, indemnify, and hold harmless Medical Database and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any law or the rights of a third party, including any patient-identifying information you submit in violation of Section 4.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to any separate arbitration agreement we may enter into with you, any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date below and, where appropriate, notify you in the App. Your continued use of LabNecessity after a change becomes effective means you accept the updated Terms.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the App, and supersede any prior agreements on the subject, except that an institution's separate agreement with us governs where it conflicts with these Terms for institutional access.
